Requirement for Power of Attorney (POAs)

Beginning today, a customs broker must get a special agreement with a power of attorney (POA) directly from the importer of record (IOR) importing the goods or getting a refund for taxes paid on exported goods.


The POA must be signed by the importer of record or drawback claimant, not through an agent or someone else. The importer of record or drawback claimants can have someone help them sign the POA, such as by providing translation services or legal advice, but they must still sign it themselves.


If a broker already has a POA signed before December 19, 2022, they have until February 17, 2023, to make sure it meets these new requirements.
