CBP Guidance: Section 301 Forced Labor Import Duties Effective July 24, 2026

U.S. Customs and Border Protection (CBP) has issued CSMS #69326983, providing implementation guidance for the U.S. Trade Representative's new Section 301 Forced Labor Import Duties. These additional duties became effective for merchandise entered for consumption or withdrawn from warehouse for consumption on or after 12:01 a.m. EDT on July 24, 2026.
Under this action, imports from 60 economies are subject to additional Section 301 duties ranging from 10% to 12.5%, depending on the country of origin and applicable HTSUS provisions.
For many importers, the most significant rates include:
Vietnam: Additional 12.5% duty
China: Additional 12.5% duty
India: Additional 10% duty
Bangladesh: Additional 10% duty
Important Exemptions
CBP identified several categories that may be exempt from the new duties, including:
Goods already in transit before July 24, 2026, that meet specific entry deadlines.
Certain pharmaceutical products.
Civil aircraft and related parts.
Informational materials.
Humanitarian donations.
Certain steel, aluminum, copper, semiconductor, vehicle, and wood products.
Additional country-specific exemptions may also apply depending on the product and trade program eligibility.
What Importers Should Do Now
Importers should review their supply chains, confirm country-of-origin determinations, and verify proper Chapter 99 reporting requirements before filing entries. Incorrect HTSUS declarations could lead to delays, duty adjustments, or compliance issues.
