Vietnam Named Priority Foreign Country for USTR's Intellectual Property Issues

On April 30, 2026, the Office of the United States Trade Representative (USTR) released its 2026 Special 301 Report on Intellectual Property Protection and Enforcement, identifying Vietnam as a “Priority Foreign Country.” This designation represents the highest level of concern under U.S. trade law for inadequate intellectual property (IP) protection and enforcement. According to USTR, Vietnam was designated due to longstanding issues related to IP rights protection and enforcement that have had a significant adverse impact on U.S. rights holders. As a result of this designation, USTR will determine whether to initiate a formal investigation under Section 301 of the Trade Act of 1974, which may involve consultations with the Government of Vietnam. While no immediate trade actions have been announced, this designation may lead to increased scrutiny of imports from Vietnam, particularly where intellectual property rights are involved. Importers should ensure that:
Products do not infringe on U.S. trademarks, copyrights, or patents

Branding, labeling, and licensing rights are fully legitimate
